Small Mine Statutory Position Assessment (SMSPA)
A simpler pathway for small, low-risk mines
Regulatory framework: The legislation requires mines to ensure that workers in key positions are qualified and competent for their roles.
Statutory requirements: Mine operators must take on, or appoint, a site senior supervisor to oversee the mining operation
Exemption and its conditions: WorkSafe WA has granted a class exemption under regulation 684 of the WHS Mines Regulations.

Who this assessment is for
This assessment is for you if you run a low-risk small surface mine in Western Australia.
Extractive licence holders
Individuals who hold an extractive licence and extract sand, gypsum, or gravel from their land for local or seasonal use.
Miners using mechanised equipment
Individuals extracting gold with tools such as a dry blower at a low-risk small operation.
Operators of small clustered pits
Situations where the mining area consists of multiple small pits in close proximity.
Simplified Pathway Eligibility
To use this simplified pathway, your mine must meet all these conditions:
Surface-only operations
Five or fewer workers employed at any one time
Not subject to Mine Safety and Inspection Regulations for levy requirements, that is 5,000 or less hours worked per quarter
No use of hazardous chemicals, such as cyanide
No use of explosives
No dredging activities
Important: Your mine must meet all these conditions. If it grows beyond these limits at any point, you will need to move to the standard SSE pathway.
